A significant part of the Firm's practice is in the representation of industrial, commercial and residential clients whose property has been targeted for acquisition by a government agency. Over the last decade, the Firm has represented numerous property owners in connection with virtually every major transportation project in New Jersey. In providing representation we take a flexible approach. We first ensure that the taking is for a public purpose, and, if so, we determine whether the acquisition as proposed should be modified to suit our client's needs. We pay particular attention to access because in many instances access changes can have a more profound effect in partial taking cases than the acquisition itself. In cases where the amount of just compensation is the principal issue, we aggressively seek to maximize the amount our client receives. In many instances we have been able to achieve significant increases in the compensation paid to our clients. Finally, we have also been able to develop and successfully negotiate creative approaches to compensation including land exchanges and the recovery of relocation costs. Blake S. Davis |
